We and our authorized service providers utilize cookies, web beacons, pixels, local storage objects, and similar tracking technologies (collectively, "Tracking Technologies") to automatically collect usage data, maintain session state, analyze site performance, and facilitate targeted advertising. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Clip My Property ("Company," "we," "us," or "our") governing your access to and use of the website located at clipmyproperty.com (the "Site") and all related services, features, content, and applications offered by the Company (collectively, the "Services"). By accessing the Site, submitting any form, uploading content, placing an order, or otherwise using the Services, you represent that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must discontinue use of the Site and Services immediately.
The Company provides cinematic walkthrough video production and related digital media services for real estate, landscaping, and other property-related applications. Videos are delivered electronically following confirmed payment at the rates displayed on the Site at the time of order. Stated delivery timeframes are estimates only and do not constitute guarantees; actual delivery may vary based on order volume and complexity. All prices are denominated in United States dollars. By submitting an order, you agree to pay all applicable fees associated with the selected service tier. Payments are processed through third-party payment processors; the Company does not directly access or store complete payment card credentials. Refund requests must be submitted in writing within seven (7) calendar days of delivery; the Company reserves the right to deny refund requests for work that materially conforms to the agreed-upon specifications.
By using the Site, you expressly consent to the collection, processing, storage, transfer, and use of personal and non-personal data as described in these Terms and our Privacy Policy. Data collected includes, without limitation, information you voluntarily provide (such as name, email, telephone number, physical and property addresses, listing URLs, project details, uploaded photographs and media, and correspondence), information collected automatically through Tracking Technologies including cookies, web beacons, pixels, local storage, and similar mechanisms (such as IP address, geolocation data, browser and device identifiers, operating system, screen dimensions, referring URLs, page views, session duration, clickstream data, scroll depth, form interaction events, timestamps, and UTM or campaign attribution parameters), and information received from third-party analytics, advertising, and data enrichment services. You further consent to the use of such data for all lawful purposes including service delivery, order processing, communications, marketing and promotional outreach, behavioral analysis, site optimization, fraud prevention, legal compliance, customer profiling, and the creation of derived or aggregated data sets.
By uploading, transmitting, or otherwise making available any photographs, images, text, or other materials through the Site ("User Content"), you grant the Company a non-exclusive, perpetual, irrevocable, royalty-free, fully sublicensable, worldwide license to use, reproduce, modify, adapt, publish, display, distribute, and create derivative works from such User Content in connection with the provision of Services and for the Company's marketing, portfolio, promotional, and social media purposes, unless you provide express written notice to the contrary. You represent and warrant that you own or have obtained all necessary rights, licenses, and permissions to grant the foregoing license and that your User Content does not infringe upon or violate the intellectual property rights, privacy rights, or any other rights of any third party.
All content, materials, trademarks, logos, designs, videos, software, and other intellectual property displayed on or available through the Site are the exclusive property of the Company or its licensors and are protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, publicly display, or create derivative works from any such content without the Company's prior written consent. Videos produced pursuant to an order are licensed to you solely for use in marketing the specific property or project for which they were commissioned.
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. IN NO EVENT SHALL THE COMPANY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES, REGARDLESS OF THE THEORY OF LIABILITY. THE COMPANY'S AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO THE COMPANY FOR THE SPECIFIC SERVICE GIVING RISE TO SUCH CLAIM DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT.
You agree to defend, indemnify, and hold harmless the Company, its owners, officers, employees, contractors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Services, your User Content, your violation of these Terms, or your infringement of any rights of any third party. The Company reserves the right to modify, amend, or update these Terms at any time by posting revised Terms on the Site with an updated effective date; your continued use of the Site following any such modification constitutes your acceptance of the revised Terms. These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States of America, without regard to its conflict of law provisions, and any disputes arising hereunder shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Florida. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
